I. Genareal Introduction

The Bac Lieu Justice Department established  in accordance with decision No.13-QD/UB dated January, 01 1997 of The provisional People’s Committee of Bac Lieu province ( at the same time with re-establishment of Bac Lieu province), the Department of Justice is the professional body under the Bac Lieu People’s Committee on functions, tasks, consultants to assist the provincial People’s Committee of State management implementing in the fields: preparing and implementating of legal document, inspecting, handling of legal document, popular and legal education, civil enforcement, notarization, authenticate, child adoption involving foreign elements, commercial arbitration, civil status, nationality, judicial resume, lawer, legal consultancy, legal aid, judicial assessment, reconciliation at the grassroots, auctioning assets, judicial work as the provision of law.

The Bac Lieu Justice Department has legal status, own stamp and account, subject to the direction and oraganizational management, staffing, and work of People’s Committee as well as subject the direction, instruction and checking of professional skills of  the Ministry of Justicle.

Legal Basis

-  According to Decision No.13-QD/UB on January, 01 1997 of the Bac Lieu interim Chairperson  on the establishment of the Department of Justice.

- According to Decision No.08/2010/QD-UBND dated June,14 2010 of the Chairman of the Bac Lieu province on the promulgating the regulation of functions, duties, powers, organizational structures and working relationships of the Bac Lieu Justice Department.

* Function and duty

I. Position and Function

1. Department of Justice is an office directly under Provincial People’s Committee. Department of Justice gives advice and helps Provincial people’s committee carry out the State management’s functions about: construction assignment and legal instrument execution: inspection and popularization; law education: civil case implement; the notarized; the certified; adopted children with foreign factor; commercial arbitrator; civil status; nationality; judicial curriculum vitae; lawyer; legal counseling; legal aid; legal expertise; reconciliation in locals; property auction and other judicial works according to the law.

2. Department of Justice has qualities, seal, and private account under Provincial People’s Committee about organization management, personnel, Besides, Department of Justice is directly under the guide, examination about specialized work of Ministry of Justice.

II. Duty and Power

1.     Report to Provincial People’s Committee:

a.     Draft resolution, direction and other written belonging to the competence of People’s Committee in justice field.

b.    Draft long term plans, 5-year plans, every year plans and projects, programs, methods for mission of state administrative reform, judicial  innovation, construction, law system improvement belonging to state management of  Justice Department.

c.     Draft development planning for lawyer, notary, property auction branch and other judicial branches in locals belonging to state management of Justice Department.

d.    Draft law document that assigns specific condition; standard titles of chief, assistant chief belonging to Justice Department and Justice Division of People’s Committee in towns, cities.

2.     Report to Provincial People’s Committee:

a.     Draft resolution to establish, merge and disintegrate organization of Justice Department.

b.    Draft resolution, direction belonging to the competence of the president of People’s Committee about judicial assignment management in locals.

3.     Guide, check and organize to carry out legal instrument, plans, programs, projects conferred by state management.

4.     Build legal instrument:

a.     Cooperate with People’s Committee Division to report  to Provincial People’s Committee that approves and correct the construction programs of legal instrument ; along with Home Affairs Department and Finance  Department to draft resolution about construction and report to People’s Council.

b.    Compose drafts of legal instrument under the competence of Provincial People’s Committee and other specialized bodies.

c.     Evaluated the drafts of legal instrument by provincial People’s Council and People’s Committee.

d.    Organize to collect civilian’s suggestions about plans, draft directly under Provincial People’s Committee and Ministry of Justice.

5.     Carry out legal instrument:

a.     Watch legal instrument execution in locals.

b.    Guide specialized works and watch law execution belonging to management field of specialized bodies of district People’s Committee.

c.     Summarize and report to Provincial People’s Committee and Ministry of Justice about legal instrument execution in locals and propose methods to deal with problems.

6.     Examine legal instrument:

a.     Help Provincial People’s Committee check their written.

b.    Examine legal instrument of Provincial People’s Committee and district People’s Committee; guide specialized bodies of district People’s Committee and People’s Council to check their legal instrument.

c.     Examine, speed up and carry out to deal with illegal written.

7.     Organize to check the systematization of  People’s Council’s and Provincial People’s Committee’s legal instrument; guide and check  the systematization of legal instrument of district People’s Committee, specialized bodies of  Provincial People’s Committee.

8.     Give advice and help Provincial People’s Committee to carry out state management mission about compensation in locals according to compensation article in Liability Law of the State and instruction document.

9.     Popularize and educate law:

a.     Organize to carry out programs, popular plans and educate law in locals after the approval of the president of Provincial People’s Committee.

b.    Establish Permanent Council to cooperate with popularization assignment, law education in provinces.

c.     Establish law reporter staff; edit and publish document to serve popularization assignment, law education.

d.    Propagandize and spread and educate law about management fields of Justice Department.

e.     Guide to instruct and manage, take advantage of law books in towns, units and other offices.

10.   Control, cooperate with Culture, Sports and Tourism Department and department involved to help Provincial People’s Committee about village regulation construction, convention in small villages.

11.  Help Provincial People’s Committee carry out mission, power on civil case execution in locals.

12.  Notarize and certify:

a.     Organize to carry out development planning and notarized work in locals after Provincial People’s Committee’s approval, advice, proposal about methods to develop notarized work.

b.    Guide and check the activities and organization of Notary Public’s Offices in locals.

c.     Receive and check files and report to Provincial People’s Committee to found and take back the resolution about Notary Public’s Offices establishment and the registered paper of notary office. Carry out the projects about establishment and disintegration of notary office after Provincial People’s Committee’s approval.

d.    Propose the Minister of Justice Ministry to appoint or dismiss notary.

e.     Guide, check and foster professional skill for specialized units under district People’s Committee and civil servants of Justice-Civil status directly under town People’s Committee about conferring and certifying copies from the original and signature.

13.  Civil status, nationality, adopted children with foreign  factor and judicial curriculum vitae:

a.     Control and guide  to carry out registered  assignment and civil status management with district Justice division civil servants of Justice-Civil status directly under  town People’s Committee

b.    Construct the system of registered organization and civil status management and foster professional skill for officers of civil status assignment.

c.     Solve directly the matter of civil status, adopted children with foreign factor belonging to the competence of Provincial People’s Committee.

d.    Evaluate files and report to Provincial People’s Committee to solve the matter of civil status, adopted children with foreign factor belonging to the competence of Provincial People’s Committee.

e.     Propose Provincial People’s Committee to take back, remove civil status paper conferred illegally by district People’s Committee.

f.     Manage, use and reserve civil city population register, form and confer the copies.

g.    Confer judicial curriculum vitae paper and manage and reserve its files.

h.     Deal and examine nationality files and report to Provincial People’s Committee to investigate and propose or solve according to the competence, management, and reserve of nationality files.

14.   Lawyer and law counselor:

a.     Evaluate files and report to Provincial People’s Committee to establish or disintegrate and approve the resolution of the lawyers’ association.

b.    Confer and take back registered paper of practice as a lawyer, legal counseling centers and certificate of law counselor.

c.     Provide information about the registration of lawyer’s office, Law Company for government agency, organization, individuals. Practice as a lawyer must report their activities when necessary.

d.    Carry out plans, projects to develop the organization of practice as a lawyer in locals after Provincial People’s Committee’s approval, advice and proposal.

e.     Foster skills of legal counseling and aid to foster professional skill for legal counselor.

f.     Guide and examine the organization and activities of lawyers’ association; practice as a lawyer and legal counseling centers.

15.  Legal aid:

a.     Manage and guide the organization and activities of these centers and branches of legal counseling center of the government. Join to aid legal of lawyer’, law company, s office legal counseling centers.

b.    Foster professional skill for the objects of legal aid in locals.

c.     Confer, change and take back the registered paper of legal aid of lawyer’s office, Law Company, s office legal counseling centers.

d.    Recognize, confer and take back the cards of legal aid contributors.

16.  Property auction:

a.     Carry out development planning of property auction in locals after Provincial People’s Committee’s approval, advice, proposal to develop the organization of property auction in locals.

b.    Examine and inspect the organization and activities of property auction in locals.

17.  Help Provincial People’s Committee about judicial survey and commercial arbitrator.

18.  Guide and check reconciliation assignment in locals.

19.  Control, guide and check professional skill about legislation assignment of specialized bodies belonging to Provincial People’s Committee and enterprise. Carry out or cooperate to aid legal for business.

20.   Organize and control inspection mission and check law execution in Justice Department; Solve complaints, accusation and prevent corruption, waste and deal with law breaking act.

21.  Cooperate with international about law and judicial mission.

22.   Research and apply science and information technology in Justice Department’s fields.

23.  Propagandize, count, summarize, report periodically and unexpectedly about the process according to the resolution of Provincial People’s Committee and Justice Ministry.

24.   Set function, duty, power, organization structure, and mission relationship of  Justice Department; staff management carry out salary policy, treatment policy, training, foster, reward and discipline with civil servants and employees according to  the resolution and the level of Provincial People’s Committee.

25.  Guide and check independence mechanism and take full responsibility directly under Justice Department.
